1. Introduction
Welcome to FerryPros. These Terms of Service govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.
2. Definitions
"Service" refers to the FerryPros website and platform that connects aircraft owners with pilots.
"User" refers to individuals who register on our platform, including aircraft owners and pilots.
"Content" refers to all information displayed on our website, including text, images, audio, video, and graphics.
"Verified User" refers to users who have successfully completed our identity verification and/or background check processes.
"Strike" refers to a formal warning or penalty issued to a user's account for policy violations.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
4. Identity Verification Services
FerryPros utilizes third-party identity verification services to help ensure the safety and security of our platform. By using our services, you consent to the following verification processes:
4.1 Identity Document Verification
Users may be required to submit government-issued identification documents (such as passports, driver's licenses, or government IDs) for verification. These documents are processed through our secure third-party verification partner to confirm your identity. Document verification includes:
- Verification of document authenticity and validity
- Extraction and validation of personal information
- Document expiration date verification
- Cross-referencing with submitted application information
4.2 Biometric Verification (Liveness Detection and Face Matching)
To prevent fraud and impersonation, we employ biometric verification that includes:
- Liveness Detection: Users may be required to take a live selfie or video to confirm they are a real person and not using photographs or other fraudulent methods
- Face Matching: The selfie is compared against the photo on submitted identity documents to verify the user is the legitimate document holder
Biometric data is processed in accordance with applicable privacy laws and is used solely for identity verification purposes.
4.3 Background Check Services
Pilots and certain other users may be required to undergo background checks as a condition of using our platform. Background checks may include, but are not limited to:
- Criminal history records search
- Sex offender registry search
- Global watchlist and sanctions screening
- Identity verification and address history
- Professional license verification
By requesting or consenting to a background check, you authorize FerryPros and our third-party background check providers to obtain and review this information. Background check results are confidential and are used solely for determining eligibility to use certain features of our platform.
4.4 Pilot Credential Verification
Pilots using our platform may be required to verify:
- Valid pilot certificates and ratings (verified through FAA records where applicable)
- Current medical certificate status and class
- Flight experience and qualifications
- Insurance documentation
Pilots must maintain current and valid credentials throughout their use of the platform. Expired or revoked credentials may result in suspension of platform privileges.
4.5 Verification Data Handling
All verification data is handled in accordance with our Privacy Policy. We retain verification records as required by law and for legitimate business purposes. Users have the right to request information about their verification status and may appeal verification decisions through our support channels.
4.6 Verification Limitations and User Responsibility
IMPORTANT DISCLAIMER: All verification services provided by FerryPros are offered on a "best effort" basis.
While we employ industry-standard verification processes and third-party services to verify user identities, credentials, and background information, FerryPros does not guarantee and cannot warrant:
- 100% accuracy of any verification results or background check information
- Completeness of criminal history or background screening results
- The continued validity of credentials after verification (e.g., licenses may be revoked or expire)
- The accuracy of self-reported information provided by users
- The behavior, performance, or conduct of any verified user
- That verification services will detect all instances of fraud, misrepresentation, or disqualifying information
User Responsibility: Users are strongly encouraged to conduct their own due diligence before entering into any agreements or transactions with other users on the platform. This includes but is not limited to:
- Independently verifying pilot credentials through official sources (e.g., FAA Airmen Inquiry)
- Requesting proof of current insurance coverage
- Verifying medical certificate validity
- Checking references and reviews from previous jobs
- Meeting or conducting video calls before agreeing to services
- Reporting any suspected discrepancies or concerns to FerryPros immediately
If you suspect that any user has provided false or inaccurate information, or if verification results appear inconsistent with other information, you should:
- Refrain from entering into agreements with that user until concerns are resolved
- Report your concerns to FerryPros through our reporting system
- Conduct independent verification through official channels
FerryPros is not liable for any damages, losses, or harm resulting from reliance on verification information, including but not limited to incomplete background checks, undetected credential issues, or user misrepresentation.
5. Services and Fees
FerryPros provides a platform for aircraft owners to connect with qualified pilots for ferry services. We charge fees for the use of our platform, escrow services, and other features as outlined on our pricing page.
All fees are subject to change with notice. We will provide users with advance notice of any fee changes.
6. User Conduct
You agree not to use the Service for any illegal purposes or to conduct any unlawful activity, including, but not limited to:
- Fraud, theft, or any other illegal activities
- Posting false or misleading information
- Harassing, threatening, or intimidating other users
- Attempting to gain unauthorized access to our systems or other users' accounts
- Submitting false reports against other users or job listings
- Circumventing the platform's payment or escrow systems
- Creating multiple accounts to evade restrictions or bans
7. Strike System and Account Restrictions
FerryPros maintains a strike system to address policy violations and maintain platform integrity. Understanding this system is essential for all users.
7.1 Strike Severity Levels
Strikes are issued based on the severity of the violation:
- Warning: Minor first-time offenses that do not significantly impact other users
- Minor: Policy violations that have limited impact but require correction
- Major: Serious violations that significantly impact other users or platform integrity
- Severe: Egregious violations including fraud, safety concerns, or repeated serious offenses
7.2 Strike Durations
Strikes remain on your account for varying durations:
- 1 Month: Typically for warnings and minor infractions
- 6 Months: For more significant violations
- 12 Months: For major violations
- Permanent: For severe violations or repeated offenses
7.3 Consequences by Strike Count
Accumulating strikes results in progressive restrictions:
- 1 Strike: Warning status; no immediate restrictions, but further violations will result in penalties
- 2 Strikes: Limited to 5 job posts and 5 bids per month
- 3 Strikes: Limited to 2 job posts and 2 bids per month
- 4 Strikes: Cannot post new jobs or bid on jobs; may only complete existing work
- 5+ Strikes: Account suspension; cannot use any platform features
7.4 Strike Sources
Strikes may be issued as a result of:
- Verified job reports from other users
- Administrative review of policy violations
- False reporting (strikes issued to users who submit fraudulent reports)
- Violation of verification requirements
- Safety-related incidents
7.5 Strike Appeals
Users have the right to appeal strikes they believe were issued in error. The appeal process includes:
- Submission of a written appeal explaining why the strike should be reconsidered
- Opportunity to provide supporting evidence
- Review by our administrative team
- Notification of the appeal decision
Appeals must be submitted within 30 days of the strike being issued. Successfully appealed strikes will be overturned and removed from your account record. Denied appeals will result in the strike remaining active for its original duration.
8. Job Reporting and Listing Integrity
FerryPros takes the integrity of job listings seriously. Users can report listings they believe violate our policies, but this privilege comes with responsibility.
8.1 Reportable Violations
Users may report listings for the following reasons:
- Fraud: Fraudulent listings or scams
- Spam: Spam or promotional content unrelated to ferry services
- Inappropriate Content: Offensive or inappropriate content
- Fake Listing: Fake or non-existent jobs
- Policy Violation: Violations of platform terms or policies
- Dangerous Job: Unsafe or dangerous job conditions
- Discriminatory: Discriminatory requirements
- Misleading Compensation: Misleading pay or budget information
- Unlicensed Operator: Unlicensed or unqualified operators
8.2 Report Review Process
All reports are reviewed by our administrative team through the following process:
- Initial review and acknowledgment of the report
- Investigation of the reported listing and associated accounts
- Decision to resolve (take action) or dismiss the report
- Notification to relevant parties of the outcome
8.3 Consequences for False Reports
Submitting false or malicious reports is a serious violation of our Terms of Service.We track reporting history for all users and monitor for patterns of abuse.
Users who submit false reports may face the following consequences:
- First Offense: Warning and documentation of the false report
- Repeated False Reports: Issuance of strikes to the reporting user's account
- Pattern of Abuse: Suspension of reporting privileges and potential account restrictions
- Malicious Intent: Immediate strikes and possible account suspension if reports are found to be intentionally false and harmful
We calculate and monitor each user's report dismissal rate. A high dismissal rate (reports determined to be unfounded) may result in automatic review of your reporting privileges and potential account action.
9. Disputes and Resolution
Disputes may arise between aircraft owners and pilots regarding job completion, payment, or other matters. FerryPros provides a structured dispute resolution process.
9.1 Initiating a Dispute
Either party to a job may initiate a dispute if they believe the other party has not fulfilled their obligations. When a dispute is opened:
- The associated escrow funds are held until resolution
- Both parties are notified and given opportunity to respond
- The dispute is assigned for administrative review
9.2 Evidence and Documentation
Both parties may submit evidence to support their position, including:
- Communication records
- Photos or videos
- Documentation of work completed or issues encountered
- Third-party verification or records
Evidence must be submitted within the timeframe specified in the dispute notification. Failure to provide requested information may result in a decision against the non-responsive party.
9.3 Resolution Options
Disputes may be resolved through several methods:
- Full Payment to Pilot: If the pilot fulfilled their obligations
- Full Refund to Owner: If the pilot did not fulfill their obligations
- Partial Payment: When both parties share responsibility or partial completion occurred
- Mutual Agreement: Parties may reach their own settlement at any time
9.4 Escalation
Disputes that cannot be resolved through standard review may be escalated for priority handling. Escalated disputes are reviewed by senior administrators and may involve additional investigation.
9.5 Finality of Decisions
Administrative decisions on disputes are final and binding. By using our escrow services, you agree to accept the outcome of our dispute resolution process. Repeated disputes or frivolous dispute submissions may result in strikes or account restrictions.
10. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of FerryPros. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FerryPros.
11. Limitation of Liability
In no event shall FerryPros, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
FerryPros is not responsible for the actions, conduct, or quality of work of any user on the platform. While we implement verification and safety measures, users engage with each other at their own risk.
11.1 Verification Service Limitations
FerryPros expressly disclaims any liability related to our verification services, including but not limited to:
- Errors, omissions, or inaccuracies in third-party verification data
- Delays in background check processing or credential verification
- Changes to a user's status after verification (e.g., license suspension, new criminal charges)
- Limitations in database coverage for background screening services
- False positives or false negatives in identity verification or face matching
- Information that was not available or not reported to third-party verification providers
THE VERIFICATION SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 User Due Diligence
You acknowledge and agree that:
- Verification badges or status indicators are for informational purposes only and do not constitute an endorsement or guarantee by FerryPros
- You are solely responsible for making informed decisions about engaging with other users
- You should independently verify any information critical to your safety, financial interests, or legal compliance
- The absence of negative verification results does not guarantee the trustworthiness or competence of any user
12. Indemnification
You agree to indemnify, defend, and hold harmless FerryPros and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
Continued use of the platform after changes take effect constitutes acceptance of the modified Terms.
